You are responsible for your actions while using Yak's services. You must comply with all rules, regulations and acceptable usage policies that are in force for each service you access. If you act recklessly, irresponsibly or your actions endanger Yak's services, your access may be suspended or terminated at any time by Yak without notice to you.
Purpose:
This document constitutes the Acceptable Use Policy for Yak's services.
This document describes the guidelines that Yak uses in providing services to its customers and the rules to which Yak customers must adhere in order to continue to enjoy and allow others to enjoy optimum use of Yak's services via its network and systems.
In particular, you agree that whilst using Yak's services, you will not carry out the following:
- Fraud: Store, display, send or distribute material, of an illegal or fraudulent nature, including activities prohibited under any applicable state and Commonwealth law. This involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.
- Hacking: Access or attempting to access the accounts of others; or any penetration or attempted penetration security measures of other systems, whether or not the intrusion results in corruption or loss of data.
- Unauthorized Computer/Network Trespass: Compromise the security or integrity of any network or system;
- Obscene Speech or Materials: Store, display, send or distribute material which is obscene, indecent, pornographic or confidential material that could give rise to civil or criminal proceedings;
- Defamatory or Abusive Language: Store, display, send or distribute material which defames, harasses, threatens, abuses, menaces, offends or violates the privacy of any person;
- Inappropriate Use: Store, display, send or distribute material which interferes with other users or restricts any person or which inhibits any other user from enjoying the Services, the Internet and Yak's network and systems;
- Spamming: Distribution of unsolicited e-mail or advertising to multiple recipients to overload any network or system. Such an offense negatively impacts mail system performance. Yak may, in its sole discretion and without notice, remove any domain which either by support or inaction allows the sending of Spam;
- Distribution of Viruses: Place any viruses or other similar programs on the Service or the Internet with the intention to and/or cause damage, harassment, or annoyance to persons, data and/or computer systems;
- Forging of Headers: Forge header information, email source address or other user information;
- Spying: Access, monitor or use any data, systems or networks, including another person's private information, without authority or attempt to probe, scan or test the vulnerability of any data, system or network;
- Unauthorised Access: Use another person's name, username or password or otherwise attempt to gain access to the account of any other Yak customer;
- Harassment: Harass or abuse, whether physical, verbal or written to other users or Yak staff members.
- Third Party Accountability: You are responsible and accountable for any activity by third parties using your account that violates the Acceptable Use Policy and our Terms of Service;
- Illegal Activities: Breach any laws, codes, standards and content requirements of any relevant authority. Users are referred to the ACCC web site (www.accc.gov.au).
Tamper with, hinder the operation of or make unauthorised modifications to any network or system, or attempt any of the above acts or permit another person to do any of the above.
E-mail
You shall not:
- Send e-mails or post messages which are unlawful, excessively large, obscene, vilifying, or contain libellous content;
- Send unsolicited advertisements ("SPAM"), chain letters or similar e-mails;
- Use Yak as a relay for e-mail without Yak's express permission;
- Modify the sender, time, server or other header information of e-mails;
- Send large numbers of e-mail to one address with the purpose of interfering with the use of that address;
- Accumulate email to a volume larger than 5 Mb on the Yak server without downloading it.
